Let’s start with ACAS.<\/p>\n\n\n\n

\nEveryone should be treated with dignity and respect at work.<\/p>\n<\/blockquote>\n\n\n\n
They offer the following definitions<\/p>\n\n\n\n
\nHarassment as defined in the Equality Act 2010 is:<\/p>\n\n\n\n
Unwanted conduct related to a relevant protected characteristic, which has the purpose or effect of violating an individual\u2019s dignity or creating an intimidating, hostile, degrading, humiliating or offensive environment for that individual.<\/p>\n<\/blockquote>\n\n\n\n
and<\/p>\n\n\n\n
\nBullying may be characterised as<\/p>\n\n\n\n
Offensive, intimidating, malicious or insulting behaviour, an abuse or misuse of power through means that undermine, humiliate, denigrate or injure the recipient.<\/p>\n<\/blockquote>\n\n\n\n
So Harassment relates to a protected characteristic.<\/p>\n\n\n\n
There can be no “I didn’t mean it” defence to bullying although it’s not a crime, it would seem unless the bullying can be covered by the Equalities Act.<\/p>\n\n\n\n
