These stand for Digital Services\/Market\/Governance Acts. I wonder if this the EU&#8217;s equivalence of the UK&#8217;s <a title=\"a blog at the ORG\" href=\"https:\/\/www.openrightsgroup.org\/blog\/org-response-to-data-a-new-direction\/\">Data: A new direction<\/a>. Much of the seminar, or the bit I stayed for was does this conflict with the GDPR. The answer is probably; it will certainly increase the cost of compliance.\u00a0 I have written a couple of times here and on <a href=\"https:\/\/www.linkedin.com\/in\/davelevy\/recent-activity\/\">my linkedin blog<\/a> that I believe the Commission has always been more aligned with business need and the needs of the security services where as the Parliament and the A29WP and its successor the EDPSB have been more pro-citizen. Both are concerned about the market dominance of the US datenkraken, but that boat has probably sailed. Here are my noted and links. &#8230;<!--more--><\/p>\n<p>I made some notes and did some reading; I came to the conclusion that I had to go to the <a title=\"the data governance act of the European Union\" href=\"https:\/\/eur-lex.europa.eu\/legal-content\/EN\/TXT\/?uri=CELEX%3A52020PC0767\">text<\/a> of the law, which pointed me at the Commission&#8217;s <a href=\"https:\/\/web.archive.org\/web\/20210217035128\/https:\/\/ec.europa.eu\/info\/sites\/info\/files\/communication-european-strategy-data-19feb2020_en.pdf\">declaration of strategy<\/a>.<\/p>\n<p>I captured the idea of &#8216;trusted intermediaries&#8217; and ask if this is a detente i.e. trust and verify or mandates a co-op governance models.<\/p>\n<p>The EU has a <a href=\"https:\/\/ec.europa.eu\/info\/strategy\/priorities-2019-2024\/europe-fit-digital-age\/european-data-strategy_en\">strategy<\/a> it seems, and they say more on its <a href=\"https:\/\/digital-strategy.ec.europa.eu\/en\/policies\/strategy-data\">home page<\/a> on europa. This is commented on at a site called, <a href=\"http:\/\/www.dataeconomy.eu\/eu-data-strategy-2020\/#page-content\">Data Economy<\/a>.<\/p>\n<p>I googled &#8220;trusted intermediaries&#8221; and found, a site, called &#8220;<a href=\"https:\/\/datatrusts.uk\/blogs\/data-trusts-and-the-draft-data-governance-act\">Data trusts and the draft Data Governance Act<\/a>&#8220;. Let&#8217;s see what it says.<\/p>\n<p>EDRi <a href=\"https:\/\/edri.org\/our-work\/eu-parliament-takes-first-step-towards-a-fair-and-interoperable-market\/\">talks<\/a> about the <strong>Digital Market Act<\/strong>, I note that the threshold for the anti-monopoly provisions is \u00a380bn and so likely to only impact the US datenkraken.<\/p>\n<p>The<a href=\"https:\/\/www.consilium.europa.eu\/en\/press\/press-releases\/2021\/11\/30\/promoting-data-sharing-presidency-reaches-deal-with-parliament-on-data-governance-act\/\"> concillium page<\/a> says, &#8220;The <strong>Data Governance Act<\/strong> (DGA) will set up robust mechanisms to facilitate the reuse of certain categories of protected public-sector data, increase trust in data intermediation services and foster data altruism across the EU.&#8221; The Commission proposal is <a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/EN\/TXT\/?uri=CELEX%3A52020PC0767\">here<\/a>.\u00a0 The DGA has a <a href=\"https:\/\/en.wikipedia.org\/wiki\/Data_Governance_Act\">very limited entry in wikipedia<\/a>, although it claims to have two citations that review it. One of its citations is &#8220;White Paper on the Data Governance Act&#8221; <acronym title=\"Baloup, Julie and Bayaml\u0131o\u011flu, Emre and Benmayor, Aliki and Ducuing, Charlotte and Dutkiewicz, Lidia and Lalova, Teodora and Miadzvetskaya, Yuliya and Peeters, Bert, White Paper on the Data Governance Act (June 23, 2021). CiTiP Working Paper 2021, Available at SSRN: https:\/\/ssrn.com\/abstract=3872703 or https:\/\/dx.doi.org\/10.2139\/ssrn.3872703\">from<\/acronym> a team at the U. of Leuven.\u00a0This took me to the <a href=\"https:\/\/digital-strategy.ec.europa.eu\/en\/policies\/legislation-open-data\">EU&#8217;s page on the Open Data Directive<\/a>. Is the DGA a follow-up to<a href=\"https:\/\/digital-strategy.ec.europa.eu\/en\/policies\/legislation-open-data\"> the Open Data Directive<\/a> which encouraged\/mandated that publicly held data be made available at marginal cost, through publication or API.<\/p>\n<p>Also the EU on <strong>the <a href=\"https:\/\/digital-strategy.ec.europa.eu\/en\/policies\/digital-services-act-package\">Digital Services Act<\/a><\/strong>., which acts as an anthology, for the DSA &amp; DMA.<\/p>\n<p>A Data Act is coming.<\/p>\n<h3>Regulating the Media<\/h3>\n<p><a href=\"https:\/\/www.epceurope.eu\/post\/european-parliament-s-dma-vote-paves-the-way-for-a-future-forward-media-sector\">European Parliament&#8217;s DMA vote paves the way for a future forward media sector <\/a>\u00a0from the European Publisher&#8217;s Council.
