I created this page to track the events and comments made and posted a blog article, <a href=\"https:\/\/davelevy.info\/on-wotcs-permissive-licences\/\">On WOTCs permissive licences<\/a>, also <a href=\"https:\/\/medium.com\/@deptford-dave\/on-wotcs-permissive-licences-9bd7c2f74dff\">mirrored on medium<\/a>. I also created mirrors of certain critical documents. The upshot of the story was that WOTC withdrew the proposals and published the System Resource Document (SRD) under a creative commons licence.  I revisited and amended this page in Apr 2025 when WOTC published the SRD for their 2024 rule set and I rfeproduced my document archive index on this page. <\/p>\n\n\n\n<!--more-->\n\n\n\n<a name=\"oglarchive\"><\/a>\n\n\n\n<h3 class=\"wp-block-heading\">Critical Resources aka my document archive<\/h3>\n\n\n\n<p>I have mirrored the <a href=\"https:\/\/drive.google.com\/file\/d\/180-UzvMvVKUba50NKlbZxL0EFIuBnilX\/view?usp=share_link\">Player&#8217;s Handbook<\/a>, &amp; the <a href=\"https:\/\/drive.google.com\/file\/d\/19WFtFK7LVTK7poWZpzOu1BKMLxQuKVt4\/view?usp=share_link\">OGL1.0\/SRD<\/a>. The similarity with the software industry&#8217;s open source wars and the music industries war on its customers and fans piqued my interest. This page was published on Dec 22, 2022. Much of what this page contains is contemporaneous, or at least over the next few months.<\/p>\n\n\n\n<p>This story caused an explosion amongst the creator community and it has become a fast moving story. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Links<\/h3>\n\n\n\n<ol class=\"wp-block-list\">\n<li>What wikipedia says <a href=\"https:\/\/en.wikipedia.org\/wiki\/Wizards_of_the_Coast\">about Wizards_of_the_Coast<\/a>, a a division of Hasbro, and <a href=\"https:\/\/web.archive.org\/web\/20221206102431\/https:\/\/investor.hasbro.com\/annual-report-2021\">the Hasbro Annual Report<\/a>&nbsp;which implies a 2021 Revenue to Wizards of the Coast of $1bn and a revenue to the division of over $2bn. I went looking for the WOTC riposte in <a href=\"https:\/\/dnd.wizards.com\/news\/archive\">their news archive<\/a>&nbsp; but found nothing there; they put it up on d&amp;d beyond<\/li>\n\n\n\n<li>The WOTC <a href=\"https:\/\/web.archive.org\/web\/20221221215537\/https:\/\/www.dndbeyond.com\/posts\/1410-ogls-srds-one-d-d\">riposte<\/a> stating that little will change. I believe that these links document the current state <a href=\"http:\/\/www.opengamingfoundation.org\/ogl.html\">http:\/\/www.opengamingfoundation.org\/ogl<\/a> and the <a href=\"https:\/\/media.wizards.com\/2016\/downloads\/DND\/SRD-OGL_V5.1.pdf\">SRD V5.1 with the OGL 1.0a<\/a>&nbsp; and <a href=\"https:\/\/company.wizards.com\/en\/legal\/fancontentpolicy\">the WOTC fan content policy<\/a><\/li>\n\n\n\n<li>Gizmodo did <a href=\"https:\/\/gizmodo.com\/dnd-wizards-of-the-coast-ogl-1-1-open-gaming-license-1849950634\">a piece<\/a> from a leaked version of OGL 1.1<\/li>\n\n\n\n<li>WOTC&#8217;s <a href=\"https:\/\/www.dndbeyond.com\/posts\/1423-an-update-on-the-open-game-license-ogl\">second attempt<\/a>, to clarify their thoughts, and also a third, six days later, &#8220;Have WoTC caved?&#8221;, <a href=\"https:\/\/www.dndbeyond.com\/posts\/1428-a-working-conversation-about-the-open-game-license\">a statement<\/a> by Kyle Brink dated the 18th Jan 2023. If that wasn&#8217;t capitulation then <a href=\"https:\/\/www.dndbeyond.com\/posts\/1439-ogl-1-0a-creative-commons\">this<\/a> is., WOTC <a href=\"https:\/\/www.dndbeyond.com\/attachments\/39j2li89\/SRD5.1-CCBY4.0License.pdf\">publish the SRD 5.1<\/a> under a CC BY 4.0 licence, claiming the licence belongs to someone else, and is also irrevocable. [ <a href=\"https:\/\/drive.google.com\/file\/d\/1AuVrMNKhixGVfqx5qpBYFn8mp419Iyis\/view?usp=share_link\">my mirror<\/a> ]<\/li>\n\n\n\n<li>The <a href=\"https:\/\/web.archive.org\/web\/20141231043853\/http:\/\/dnd.wizards.com\/articles\/features\/basicrules?x=dnd\/basicrules\">free player&#8217;s handbook<\/a>, and <a title=\"DnD 5e Player's Handbook\" href=\"https:\/\/drive.google.com\/file\/d\/180-UzvMvVKUba50NKlbZxL0EFIuBnilX\/view?usp=share_link\">my mirror<\/a>.<\/li>\n\n\n\n<li>Treantmonk <a href=\"https:\/\/www.youtube.com\/watch?v=5-2GpQjyyy4\">comments<\/a> on youtube on the affair, based on the first leak, he is cautious and optimistic, but <a href=\"https:\/\/youtu.be\/u6-MOrbpFl8\">changed his mind<\/a> after the Gizmodo article and <a href=\"https:\/\/youtu.be\/35-uy5WZK6c\">again after Brink&#8217;s statement<\/a>. <\/li>\n\n\n\n<li><a href=\"https:\/\/gsllcblog.com\/2019\/08\/26\/part3ogl\/\">The Damage Done by the Otherwise Ineffectual Open Gaming License<\/a>, argues it&#8217;s unneeded and basically propaganda for the idea it is. The Legal Eagle <a href=\"https:\/\/youtu.be\/iZQJQYqhAgY\">talks<\/a> about copyright, trademarks and algorithms. <\/li>\n\n\n\n<li>The <a href=\"https:\/\/www.dungeonmastersvault.com\/help\/faq-about-orcpub-and-dungeonmastersvault\/\">ORCPUB affair, by those<\/a> who rescued the code, which I thought might be relevant but it seems I was being over suspicious. The publishers of that article, <a href=\"https:\/\/www.dungeonmastersvault.com\">dungeon masters vault<\/a> also have a character repo. <\/li>\n<\/ol>\n\n\n\n<p>On 13th Jan, I discovered <a title=\"Pathfinder's publisher!\" href=\"https:\/\/paizo.com\/community\/blog\/v5748dyo6si7v?Paizo-Announces-SystemNeutral-Open-RPG-License\">Paizo&#8217;s response<\/a>, to assert that the OGL cannot revoked, that they believe their material is now free of WOTC intellectual property and that they are launching their own license, the Open RPG Creative Licence. Dice Breaker&#8217;s Matt Jarvis <a href=\"https:\/\/www.dicebreaker.com\/companies\/paizo\/news\/pathfinder-maker-paizo-open-rpg-creative-license\">also comments<\/a>.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">More &#8230;<\/h3>\n\n\n\n<p>I&#8217;d say, they don&#8217;t want to turn into GW, who earned \u00a3386.6m revenue last year, which will include income from minis and game software income. I note that Warhammer is a competitive wargame, D&amp;D is a collaborative story telling game. DnD would seem to be three times as large as Warhammer. Maybe not, the WOTC numbers include Magic the Gathering&#8221;.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Statement No 3.<\/h3>\n\n\n\n<p>Issued by WOTC includes the following statements<\/p>\n\n\n<div class=\"wp-block-image\">\n<figure class=\"alignleft size-full\"><a href=\"https:\/\/davelevy.info\/wiki\/wp-content\/uploads\/2024\/10\/OQuote_GreyTransparent.png\"><img loading=\"lazy\" decoding=\"async\" width=\"47\" height=\"35\" src=\"https:\/\/davelevy.info\/wiki\/wp-content\/uploads\/2024\/10\/OQuote_GreyTransparent.png\" alt=\"&quot;\" class=\"wp-image-12197\" srcset=\"https:\/\/davelevy.info\/wiki\/wp-content\/uploads\/2024\/10\/OQuote_GreyTransparent.png 47w, https:\/\/davelevy.info\/wiki\/wp-content\/uploads\/2024\/10\/OQuote_GreyTransparent-45x35.png 45w\" sizes=\"auto, (max-width: 47px) 100vw, 47px\" \/><\/a><\/figure><\/div>\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>Any changes to the OGL will have no impact on <strong>at least<\/strong> these creative efforts:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Your video content.<\/strong> Whether you are a commentator, streamer, podcaster, liveplay cast member, or other video creator on platforms like YouTube and Twitch and TikTok, you have always been covered by the <a href=\"https:\/\/company.wizards.com\/en\/legal\/fancontentpolicy\" target=\"_blank\" rel=\"noopener\">Wizards Fan Content Policy<\/a>. The OGL doesn\u2019t (and won\u2019t) touch any of this.<\/li>\n\n\n\n<li><strong>Your accessories for your owned content.<\/strong> No changes to the OGL will affect your ability to sell minis, novels, apparel, dice, and other items related to your creations, characters, and worlds.<\/li>\n\n\n\n<li><strong>Non-published works, for instance contracted services.<\/strong> You use the OGL if you want to publish your works that reference fifth edition content through the SRD. That means commissioned work, paid DM services, consulting, and so on aren\u2019t affected by the OGL.<\/li>\n\n\n\n<li><strong>VTT content.<\/strong> Any updates to the OGL will still allow any creator to publish content on VTTs and will still allow VTT publishers to use OGL content on their platform.<\/li>\n\n\n\n<li><strong>DMs Guild content.<\/strong> The content you release on DMs Guild is published under a Community Content Agreement with Dungeon Masters Guild. This is not changing.<\/li>\n\n\n\n<li><strong>Your OGL 1.0a content.<\/strong> Nothing will impact any content you have published under OGL 1.0a. That will always be licensed under OGL 1.0a.<\/li>\n\n\n\n<li><strong>Your revenue.<\/strong> There will be no royalty or financial reporting requirements.<\/li>\n\n\n\n<li><strong>Your ownership of your content.<\/strong> You will continue to own your content with no license-back requirements.<\/li>\n<\/ul>\n<\/blockquote>\n\n\n\n<h3 class=\"wp-block-heading\">My road to here<\/h3>\n\n\n\n<p>While letting my thoughts mature, I sought to compare this with the software industry and found, an article <a href=\"https:\/\/snyk.io\/learn\/what-is-a-software-license\/\">what-is-a-software-license<\/a>, which categorises licences on a scale from PD, to &#8220;All Rights Reserved&#8221;. It seems to me that the OGL has always been a Copyleft licence; material can be used under certain conditions, one being that the new material must be a book or static file, or free.<\/p>\n\n\n\n<p>I made and discarded some notes.<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>What\u2019s happening, movies, streaming content e,g, d&amp;d beyond, and VTT\u2019s, while they say they won\u2019t compete I think they might. They\u2019ll also want to licence and charge for 3<sup>rd<\/sup> Party MMORPGs and competitors to D&amp;D beyond. They make a shit load of money.<\/li>\n\n\n\n<li>It seems they plan to put a financial limit on the OGL, or maybe not. The financial limits are stated in the Fan Content Policy.<\/li>\n\n\n\n<li>To what extent do we as players care?<\/li>\n\n\n\n<li>Books can be charged for!<\/li>\n\n\n\n<li>New Rules i.e. one D&amp;D, new revenue channel, new licences, free 3<sup>rd<\/sup> party content for games supplied as text and images is permitted provided its free to use<\/li>\n\n\n\n<li>OGL how to use their content, and SRD, those parts of the rules they permit use. The OGL claims to be irrevocable and so the old version will allow access to the [old] SRD.<\/li>\n\n\n\n<li>Pathfinder shows what happens when it goes wrong, is it just the Hasbro suits don\u2019t get it. Or that they will leave story telling alone; Critical Role has shown that if you make yourself important enough to them, they&#8217;ll buy [some] rights to your content.<\/li>\n\n\n\n<li>The fan policy seems fair-ish, and kindly written.<\/li>\n<\/ol>\n\n\n\n<p>And made this summary of a 1500 word article<\/p>\n\n\n\n<p>There\u2019s probably a change coming in WOTC\u2019s zero cost licensing of D&amp;D although their statement says that they will probably only change the Fan Content policy which requires fan content to be free to the market. What is there today is less than some seem to think. It\u2019s not in the interests of WOTC to eliminate or reduce the business opportunity the current licencing permits, but it seems they plan to extend their offerings into games and movies and want\/need to assert their copyright ownership of what has always only been available under specific bi-lateral agreements and to assert and protect their trademarks. Third party creators will probably be able to continue to monetise what they already have as they will keep rights under the OGL; they will also have the ability to move their content to an alternative rule set which is in the interest of neither party.<\/p>\n\n\n\n<p>The more I think, the more I read, I think this is about <a href=\"https:\/\/www.dicebreaker.com\/games\/dungeons-and-dragons-5e\/news\/dnd-virtual-tabletop-revealed\">transforming DnD Beyond into a virtual table top<\/a>. I really wonder if investing in virtual table tops before the COVID is really finished is wise. <em>On reflection I think this is&nbsp; about annuity income and getting players to pay more. DnD Beyond offers streaming access to the rules.&nbsp;<\/em> <\/p>\n\n\n\n<p><s>The <a href=\"https:\/\/gizmodo.com\/dnd-wizards-of-the-coast-ogl-1-1-open-gaming-license-1849950634\">gizmodo article<\/a> says that royalties are planned to be charged at 25% on <strong>revenue<\/strong>. <\/s> The 3rd statement says that there will be no royalties on material designed as part of the game. <\/p>\n\n\n\n<p>I wrote a blog article, on this, called <a href=\"https:\/\/davelevy.info\/on-wotcs-permissive-licences\/\">On wotcs permissive licences<\/a>&nbsp;which I <a href=\"https:\/\/medium.com\/@deptford-dave\/on-wotcs-permissive-licences-9bd7c2f74dff\">mirrored on medium<\/a>.<\/p>\n\n\n\n<p>On 10th Jan 23, I wrote this,<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>I think that if a 3<sup>rd<\/sup> Party publisher told WOTC to shove OGL 1.1 up their arse, they could continue to ship their product on the basis of OGL 1.0(*) provided they restricted their use of WOTC material to the SRD. This would mean they could not use trademarks nor milieux &nbsp;nor could they adapt their game to One D&amp;D rules (now known as D&amp;D 2024. This maybe why they\u2019re changing the rules from 5e to One D&amp;D to create a legal fork.<\/p>\n\n\n\n<p>OGL 1.0 permits the use of the SRD in perpetuity and selling of printed material. Signing 1.1 would mean losing that promise of both free and forever, in fact it would mean that whatever you ship warrants, a steep 25%, royalty payment irrespective of whether the product is restricted to the SRD or not.<\/p>\n\n\n\n<p>This is an <strong>invitation to fork the rules<\/strong>. It\u2019ll be interesting to see what the big boys do, although they may get a better deal.<\/p>\n\n\n\n<p>It also has happened before, when Oracle bought Sun and re-enclosed Sun\u2019s software portfolio. Open Solaris survived and transformed into Illumos for which there remains, 13 years later, a number of implementations.
